Making neighbour's daughter pregnant

Kota Kinabalu: A former convict who raped his neighbour's daughter until she became pregnant and gave birth, was jailed 20 years and ordered given 10 strokes of the cane.

Sessions Court Judge Azreena Aziz handed the sentence to Jikau Gani, 52, who pleaded guilty to the offence, Monday.

The court also ordered Jikau to pay compensation of RM10,000 to the victim or spend another six months.

After completing his jail sentence, Jikau would be placed under police supervision for two years.

Jikau raped the 13-year-old girl at 12.30pm in May 2016 at a room in a village in Kuala Penyu.

The offence under Section 376(2) of the Penal Code carries a jail term of up to 30 years, and whipping at least 10 strokes, on conviction.

During mitigation, Jikau who was not represented asked for leniency.

However, Deputy Public Prosecutor Husna Abdul Halim urged the court to impose a deterrent sentence on the grounds that Jikau had committed not only a serious offence but a heinous act.

She said the court should consider as a result of the rape, the victim had delivered a baby while she was very young.

Husna also submitted that Jikau was a former convict in 2002 in which he was sentenced to 10 years for committing a similar offence.

She said it showed Jikau's addiction in committing rape.

The court heard that the girl was confirmed pregnant on Sept 6, 2016 after his parents sent the victim to the hospital after complaining pain.

Further investigation, the victim revealed that she was raped by Jikau at the room.

She tried to shout for help at the time but no one heard her.

On Jan 24 this year, the victim had given a baby and the DNA report confirmed that Jikau was the biological father of the baby. - Cynthia D Baga
