Inciting boy to act of gross indecency

Kota Kinabalu: A 41-year-old man with five previous convictions was ordered to enter his defence to a charge of inciting a boy to an act of gross indecency and threatening to hurt him.Sessions Court Judge Azreena Aziz made the order on Kamil Dulagis after ruling that the prosecution had established a prima facie case against him on Tuesday.

Kamil's defence was fixed for Nov 22 (today).

On the first count, Kamil is accused of inciting the 14-year-old to the act of gross indecency at 7pm on Feb 5 this year in the bushes near the railway track in Putatan.

The offence under Section 377E of the Penal Code carries a jail term of between three and 15 years, and whipping, on conviction.

On the second count, he allegedly threatened to cause injury to the boy at the same place and time.

Eight prosecution witnesses testified during the hearing.

Deputy Public Prosecutor Husna Abdul Halim conducted the prosecution while Kamil was not represented.

In the Magistrate's Court, a technician was jailed six months for having two stolen handphones.

Lee M. Kipau pleaded guilty before Magistrate Herlina Muse to having the stolen handphones at 11.30am on Nov 10 this year at a unit in Serigaya Apartment, here.

During mitigation, Lee who was not represented, asked for a light sentence and told the court that he was not aware that the handphones were stolen things as it were sent to him for repair.
