Contractor charged with cheating man over road repair project

Kota Kinabalu: A local contractor was charged at the Magistrate's Court here, Monday, with cheating a man and attempting to cheat the same man over a road repair project.Ruddy Hanafie Mohammed Sapawae, 32, who appeared before Magistrates Afiq Agoes and Cindy Mc Juce Balitus, pleaded not guilty to the charges.

On the first count, Ruddy is accused of cheating one Hew Wai Lam @ William of RM70,000 over the purported project.

He allegedly committed the offence at noon around December 2014 at Lucy's Kitchen in Kepayan.

The charge under Section 420 of the Penal Code provides for a jail term of between one and 10 years, and whipping and fine, on conviction.

Ruddy on the second count, is accused of trying to cheat Hew of RM70,000 over similar project, which was allegedly committed at noon, also around December 2014, at the same place.

The court set Jan 10 for case management and released Ruddy on a bail of RM3,500 with RM2,500 deposited in two sureties on each charge.

Inspectors Rasydan Jasni and Albert Basiri prosecuted while Ruddy was represented by counsel Hamid Ismail.

In another case, a foreigner was jailed 26 months for having someone else's MyKad.

Azli Raski admitted before Magistrate Cindy to having one Azizul Hahim's document at 12.35pm on Nov 29 at a car park in Likas Bay here.

Inspector Albert told the court that Azli produced a photocopy of a MyKad when he was screened by policemen on the said day.

The police found the photo in the MyKad produced by Azli did not tally with the one in the system.

Azli, who was not represented, requested for a lenient sentence while Albert applied for an appropriate sentence.

Azli had committed an offence under Section 25(1)(o) of the National Registration Regulations which carries a jail term of up to three years or fine on conviction.

He was ordered be referred to the Immigration Department after serving the sentence. - Jo Ann Mool
