Jail and rotan for raping cousin

Kota Kinabalu: A 29-year-old local who raped and caused hurt to his 19-year-old cousin was jailed 20 years and ordered given three strokes of the cane.Sessions Court Judge Ainul Shahrin Mohamad handed the sentence to the man when he decided to change his plea and admitted to the charge against him on Tuesday.The man raped the girl at a house in Kiulu, Tuaran between 4am and 6am on March 23, 2017.

The offence under Section 376(2)(a) of the Penal Code carries a jail term of between 10 years and 30 years, and whipping, on conviction.The court ordered the man, who is currently serving sentence for a drug offence, to serve the jail sentence from the date of his arrest.In his mitigation, the man who was not represented, asked for a light sentence.However, Deputy Public Prosecutor Hafizah Zahidah Abdullah urged the court to impose a deterrent sentence on the grounds that it was a serious offence.

She submitted that the man not only raped the victim but also caused hurt to her.The court heard that the victim lodged a police report claiming that her cousin had raped her between 4am and 6am on March 23, last year. The man was arrested on the same day following the report.
