Filipino jailed 14 years for causing death

Kota Kinabalu: A Filipino was sentenced to 14 years' jail for causing the death of his fellow countryman at an oil palm plantation in Ranau.Sessions Court Judge Indra Ayub handed the sentence to Juan Dalion who pleaded guilty to committing culpable homicide not amounting to murder of one Gordon Batangan.Juan committed the offence at a kongsi house in Syarikat Sinar Wanita Sdn Bhd in Kg Waluhu between 6pm and 10pm on Oct 15, 2017.

The offence under Section 304(a) of the Penal Code carries a jail term of up to 30 years and liability to a fine, on conviction.The court heard that on that day Juan, his friends and Gordon were drinking alcohol at the place when suddenly a fight occurred between Gordon and one of Juan's friends.During the fight, Juan tried to calm down Gordon and prevented him from assaulting Juan's friend with a machete.Gordon had calmed down and continued their drinking sessions.

After a while, Gordon suddenly became aggressive, took the machete and continued to assault the friend.Juan then approached Gordon, took the machete from him and stabbed Gordon to death.

One of the workers who saw the incident contacted the manager of the plantation who alerted the police.Police rushed to the scene and brought Gordon to the Ranau hospital where he was pronounced dead.The post-mortem report stated that Gordon died due to a stab at the back.Stay up-to-date by following Daily Express’s Telegram channel.
