RM50,000 fine, jail for robbing handphone

Kota Kinabalu: A 23-year-old man was jailed four years and fined RM50,000 or six months' jail for robbing a woman of her handphone. Sessions Court Judge Ainul Shahrin Mohamad handed the sentence to Samit Roy, 23, after he changed his plea to guilty to the charge against him when his case was brought up for mention. Samit had robbed the 24-year-old woman at 8.30am on Nov 30, 2017 at the pedestrian walkway behind the old library building, here.

The offence under Section 392 of the Penal Code carries a jail term of up to 14 years and whipping.In mitigation, counsel Farazwin Haxdy who represented Samit asked for a lenient sentence, saying her client was desperate and unstable because he suffered from tuberculosis.Farazwin added that Samit had no educational background.Deputy Public Prosecutor Hafizah Zahidah Abdullah urged the court to impose a deterrent punishment on the grounds that Samit had committed a serious offence as well as rampancy of such case.

Hafizah said the sentence would not only give a lesson to Samit but also other would-be offenders. The court heard that the victim was on her way to work at a fast food restaurant in Jalan Segama when an unknown man approached from behind and grabbed her handphone.

The woman tried to get back her handphone but the man, later identified as Samit, managed to flee.Two civilians who passed by the area gave chase for Samit when they heard the woman's cries for help.Samit was apprehended at the bus terminal in front of the court building and was handed over to the police.Samit returned the handphone to the woman and apologised to her many times.In another court, 10 men and two women were jailed four and five months each for illegal entry.The illegal immigrants, aged between 20 and 52, pleaded guilty before Sessions Court Judge Azreena Aziz to entering the State without any valid documents.Four of the men were given a stroke of the cane each while the rest were spared the whip.Stay up-to-date by following Daily Express’s Telegram channel.

Prosecuting Officer Assistant Superintendent of Police Sabrina Jinus told the court that the foreigners were arrested at separate locations in the city after failing to produce valid documents.After completing their jail sentence, the foreigners were also ordered to be referred to the Immigration Department and their biometric data taken before their deportation to their countries. - Cynthia D Baga
