Charged with 33 counts of abusing position

Kota Kinabalu: A 41-year-old government servant was charged with 33 counts of using his position to award supply jobs to the Cure and Care Rehabilitation Centre (CCRC) in Papar to his own company as well as using false quotations amounting to RM163,437.Mohd Syamsul Jikan pleaded not guilty before Sessions Court Judge Abu Bakar Manat to all the charges against him, Thursday.

On the first to 30th counts, Syamsul is accused of using his position by submitting quotations from Syarikat Emmy Stationary, which belonged to him, to supply items to the centre.

He allegedly committed the offences between January and October 2015 at the CCRC office in Jalan Papar-Beaufort.

The offence under Section 23(1) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 is punishable under Section 24 of the same Act which provides for a jail term of up to 20 years, and a fine of not less than five times the amount involved or RM10,000, whichever is higher.

On the 31st to 33rd count, Syamsul allegedly dishonestly used fake quotations as genuine at the same place and time.

For the offence, he was charged under Section 471/465 of the Penal Code which carries a jail term of up to two years, or fine, or both, on conviction.

The court set April 25 for mention and released Syamsul on a bail of RM50,000 with RM25,000 deposited in two local sureties.

Syamsul was also ordered to report himself once every two months to MACC's office as well as surrender his passport, if any, to the court.

Earlier, Syamsul who was not represented, asked for a lower bail saying that he has six children and one of them is disabled.
