Fined over dubious health products

Kota Kinabalu: A 39-year-old woman was fined a total of RM4,000 for having unregistered health products and cosmetics without labels.Ho Weh Thin pleaded guilty before Sessions Court Judge Azreena Aziz, on Thursday.

On the first count, Ho was fined RM2,000 in default two months' jail for having 10 types of products namely, V-C Injection, Minyak Herba Asma Mujarab, Cellmaxx and Vit C Rose Hips Glutathione, among others which were not registered with the Health Ministry.

She was found having the unregistered products at the Boxes World in Centre Point Sabah Shopping Complex, here at 12pm on Aug 15, 2017.

The offence under the Regulations 7(1)(a) of the Cosmetics and Drugs Control Regulations 1984 provides for a fine of up to RM25,000 or a jail term of up to three years, or both, on conviction.

On the second count, she was fined another RM2,000 or two months' jail for having 16 types of cosmetics without labels at the same place and time.

Among the products were Jolen Crème Bleach, Tati Skincare products, Omo White Plus and Glowing Speed Whitening Turbo.

The court heard that the unregistered products and cosmetics valued at RM2,742 were seized during a raid at Ho's premises by the Pharmacy Enforcement Division.

The court allowed Ho's application to pay the fine by instalment but ordered her to pay RM2,000, Thursday.

During mitigation, Ho asked for leniency saying that the current economy was not stable and has affected her income.

However, prosecuting officer Raja Nurul Fatin Raja Kamarulzaman from the Pharmacy Department urged the court to impose an appropriate sentence on the grounds that Ho's act would affect the safety and well-being of the public.

According to Nurul, the unregistered products and cosmetics can cause side effects, especially to those with health problems, because the products were not screened and tested to ensure its effectiveness and quality. - Cynthia D Baga
