Man admits assaulting his brother over T-shirt

Kota Kinabalu: A 22-year-old jobless man pleaded guilty at the Magistrate's Court for assaulting his brother over a T-shirt.Baharudin Omar admitted to causing hurt to Majahiddin Omar, 29, at 2pm on Jan 9 at Kg Sekambu, Petagas in Putatan.However, Majahiddin, who was present in court informed Magistrate Afiq Agoes that he was instructed by his parents to withdraw the case against Baharudin.

He said if it was up to him, he would not withdraw the case because the scuffle with his younger brother had hurt him physically.Inspector Lim Swee Beng, prosecuting, applied for another mention date to get instruction from the Deputy Public Prosecutor's office and objected bail for Baharudin as he only has an IMM13 document.The court set May 8 for mention and ordered Baharudin to be remanded further.Earlier, in presenting the facts of the case, Lim said while Majahiddin was having a lunch at home, Baharudin who just woke up, scolded him for wearing a T-shirt of their younger sibling.

A heated argument ensued between them before Baharuddin punched Majahiddin's face and head and kicked his abdomen.Their father then calm them. Baharudin went into his room while Majahiddin lodged a police report against Baharudin.

Baharudin was charged under Section 323 of the Penal Code which carries a jail term of up to a year or fine or both conviction.In another case, a 41-year-old local woman claimed trial to assisting in operating an illegal lottery business.
