Indonesian to hang for killing girlfriend

Kota Kinabalu: A 33-year-old Indonesian failed in his appeal against his death sentence for murdering his girlfriend in Kundasang, Ranau four years ago.Court of Appeal Justices Dato' Abdul Rahman Sebli, Datuk Kamardin Hashim and Datuk Wira Kamaludin Md Said on Monday dismissed Menase Ladang's appeal after hearing his appeal and submission from the prosecution.

The court in their unanimous decision held that the court found no merit in the appeal.

Menase was on Jan 25, 2017 sentenced to death by the High Court here when he was found guilty after a full trial.

He was convicted of committing the crime on Hamidah Laka, 29, at 1.30pm on Oct 20, 2014 at a vegetable farm in Mesilou.

The charge under Section 302 of the Penal Code, carries the mandatory death sentence on conviction.

Earlier, counsel Farazwin Haxdy submitted among others, that Menase had no intention to kill Hamidah as they were in a relationship and planning to get married and that the weapon adduced in court may not be the weapon used in the offence.

The trial judge also failed to consider the defence of a fight occurring, submitted Farazwin.

The prosecution rebutted that there was a fight and also submitted that there was intention to kill by Menase as the prosecution's three witnesses who attended to Hamidah heard the victim said it was Menase who stabbed her.

The wounds on Hamidah's body were also consistent with the weapon used based on the pathologist's testimony, said the prosecution.

Meanwhile, the court set aside the jail term of eight years imposed by the High Court on a former teacher, who were convicted of corrupt practice and restored the previous sentence of three years imposed by the Sessions Court.

The court in its unanimous decision held that the Sessions Court did not err in passing the sentence on Amir Hassan Ali Usin, after hearing his appeal against the sentence imposed by the High Court.

Amir, 53, was on Oct 11, 2016 jailed three years and fined RM10,000 or another three months' jail after he was found guilty by the Sessions Court to have submitted a false claim to Payment Division Chief Josephine Sherilyn Joe Liew Apok from the Accountant General's Department for payment of sports garments and uniforms for children of Tabika Kemas in 2009 when the items had actually not been fully supplied.

He committed the offence between Dec 30, 2009 and Jan 7, 2010.

The offence under Section 18 of the Malaysian Anti-Corruption Commission (MACC) Act 2009, is punishable under Section 24 of the same Act, carries a jail term of up to 20 years and a fine of not less than five times the amount involved or RM10,000, whichever is higher, upon conviction.

Amir appealed to the High Court against the sentence but saw his jail term enhanced to eight years instead.
