RM400m suit against Musa withdrawn

Kota Kinabalu: The RM400 million suit filed against Tan Sri Musa Aman was withdrawn by the plaintiff, Zulkifli Kassim, here, Thursday."Today the plaintiff filed a Notice of Discontinuance in respect of his RM400 million claim against Musa," said Tengku Fuad Tengku Ahmad, who is lead counsel for Musa.In a statement, Thursday, he said: ADVERTISEMENT "We will be pursuing an order for costs against the plaintiff. This suit was filed to embarrass my client. It represents a flagrant abuse of the court's process and for that we will be seeking an appropriate order for costs against Zulkifli (plaintiff).""Further, it is clear that this plaintiff was advised or being used by certain parties or 'hidden hands', some of whom may be lawyers. "We will, of course, continue to make the appropriate enquiries since, if discovered, such conduct is a clear breach of the Advocate's Etiquette and Practice Rules," he said. ADVERTISEMENT Zulkifli was reported to have filed the suit against Musa in an advertisement that appeared in the Daily Express classifieds earlier in July. It stated that action has been commenced against Musa, the former Chief Minister, in the High Court at Kota Kinabalu.

Zulkifli is claiming RM400 million with 8 per cent interest per year until the date of satisfaction thereof; costs and any order the court deems necessary. No other details into the background of the claim was available in the Substituted Service action.On June 26, the paper reported Musa is in the United Kingdom for medical and other personal reasons.
