Man to know fate on Aug 24 for killing Filipina

Kota Kinabalu: A 24-year-old local charged with murdering a Filipina in Labuan two years ago, will know his fate on Aug 24.High Court Judge Ravinthran N. Paramaguru set the date on Friday after hearing the prosecution's additional submission to reply Adzman Boy's counsel's submission.The decision would be delivered at the Labuan High Court.

Adzman is accused of murdering his acquaintance Nerisa Linawag Abelilla, 26, between 10.30pm and 11.20pm on Aug 15, 2016 at the road leading to a water tank in Kg Sungai Lada, Labuan.The charge under Section 302 of the Penal Code carries the death sentence upon conviction. Adzman was on May 25 this year ordered by the court to enter his defence after the court ruled that the prosecution had established a prima facie case against him. Adzman opted to give his evidence under oath. Deputy Public Prosecutor Nartiah F. Mirchelle Sambatan submitted on the issue raised by Adzman's counsel on whether he hit the deceased with a metal rod.

Nartiah stated that a prosecution witness testified Adzman hit the deceased with a metal rod while Adzman testified that he did not do so.Nartiah submitted that the eye witness's evidence was more credible that Adzman's evidence because the witness' evidence was corroborated not only by the prosecution's witnesses but also by the evidence of Adzman himself.

"On the other hand, the accused gave contradicting evidence and some of his evidence do not make sense at all."A pathologist in her evidence testified that the metal rod was capable of causing the injuries sustained by the deceased which eventually caused her death.
