Lawyer is ordered to pay  Shafie RM320,000 damages
Kota Kinabalu: Semporna lawyer Datuk Ainal Fatah has been ordered to pay Chief Minister Datuk Seri Mohd Shafie Apdal RM300,000 in damages for malicious prosecution.High Court Judicial Commissioner Celestina Stuel Galid, in granting the sum to be paid by the defendant, also ordered Ainal to pay RM20,000 in costs to Shafie.

Shafie had on April 24 sued Ainal, who is an Umno Member, for malicious prosecution, by publishing in the media his application to bar the Parti Warisan Sabah President from contesting or voting in the coming 14th general election.

Shafie won a default judgment against Ainal, who had failed to file his defence on July 26. He was represented by counsel Datuk Douglas Lind while counsel Nurul Rafeeqa Abdul Mutolip appeared for Ainal.

Shafie was claiming RM1.3 million in general damages, exemplary and aggravated damages, interests, and costs as well as other relief the court may seem fit.

Lind when met by the media after the proceeding, said that the court held that the defendant did not file defence against the statement of claim by the plaintiff, which proved the claim of malicious prosecution.

Ainal's court application was thrown out by the High Court on May 8, a day before the May 9 polls. Ainal's lawyer Marcel Jude said his client intends to appeal against the decision. - Jo Ann Mool
