Labuan: A beautician was fined RM1,000 in default a year's jail by the Sessions Court here Tuesday for possession of unregistered products for sale.
Wong Siew Chin admitted before Sessions Court Judge Caroline Bee Majanil to violating Regulation 7(1)(a) of the Drugs and Cosmetics Control Regulations 1984 at 11.20am on April 6 last year at the Em Beauty House, Financial Park, here.
Prosecuting Officer Peine Ting Lee told the court that the unregistered products were discovered during a raid at the premises by a team from the State Pharmacy enforcement branch led by Normah Talib.
They found five bottles of 50ml "Minyak Pati Ibu Gamat Asli" and 12 bottles of 150ml "Minyak Pati Ibu Gamat Asli" being displayed for sale.
Peine said verification with the Drug Control Authority later confirmed that the seized products had not been registered.
The charge, under Regulation 30(1) of the Drugs and Cosmetics Control Regulations 1984, punishable under Section 12(1) of the Drug Sale Act 1952 (Amended 2000), carries a fine of not more than RM25,000 or jail term of not exceeding three years, or both.
A repeat offence carries a RM50,000 fine or jail term of not more than five years, or both.
Meanwhile, a medicine seller was fined RM300 or two months' jail after being found guilty of selling six types of medicinal products containing scheduled poison without a licence.
Yunus Mohamad claimed trial when first charged on April 24 this year to committing the offence at about 12.45pm on Sept 28, 2002 at a stall along Jalan Pasar, here.
According to the facts of the case, a pharmacy enforcement team led by Dzafarullah Daud inspected the premises and seized 14 boxes of Flucinonide Ointment containing Flucinolone acetonide, eight plastic packages of Pronicy capsule containing cyproheptadine and 39 plastic pieces of "Dexamethasone" containing hydrocortisone.
They further seized eight bottles of "Air Ikan Haruan" and 64 packets of "Herba Ikan Lintang Dan Jarum Emas" containing hydrocortisone.
The charge, under Section 13(a) of the Poison Act 1952 (Revised 1989), punishable under Section 32(2) of the same Act, carries a fine of not more than RM3,000 or jail term of not more than three years, or both.
Pharmacy Assistant Director Joseph Oyol Modili also appeared for the prosecution.
