Tawau: The Consumer Claims Tribunal here ordered a 22-year-old university's student to pay RM1,980 to a claimant for helping his friend to advertise and sell a broken vehicle clutch set through the website.Its President Datuk Dr Lawrence SH Thien said the respondent, Ammar Izzuddin, who was not present at the tribunal hearing, could only get back his Nissan Skyline HKS Twin Plate Clutch set after the plaintiff, Teh Jin Shoon, received the money from him and that any postal charges was borne by Ammar.
Thien ordered Ammar to pay Teh within 14 days.
According to Teh, he had purchased the clutch set worth RM1,800 and had paid RM180 for the Skynet postage via a website on Dec. 3, 2010.
Teh said he received the item in worn condition on Dec. 7, 2010 but it was different from what was advertised on the website, which was in 80-90 per cent in good condition.
Teh said he found the clutch did not match with the vehicle as advertised on the website when he checked the item.
He filed the claim against Ammar for not getting the actual item, which had been advertised on the website.
Ammar, 29, in his report, said the item did not belong to him and was only helping his friend to advertise it.
Ammar, who is still studying in Kuala Lumpur, also said the court should not punish him but his friend because he only received RM400 from Teh while the latter claimed for RM1,980.
Meanwhile, a passenger bus company (Delima Zamrud Express) here was ordered to pay RM500 to a 32-year-old soldier within 14 days for losing his bag in the bus.
The claimant Ely Esa told the tribunal he lost his bag at the City Bus Terminal, Inanam, Kota Kinabalu about 7am on Nov. 23, 2010 after taking the Sairah Express bus (ST 8599F) from Tawau at 7.30pm on Nov. 22, the same year.
He said during the journey, the bus broke down at Leka Industrial area and all the passengers had to wait for two hours for another bus for Kota Kinabalu.
He added that, he moved his bag to Express Delima with a plate number WFH 1395 by himself when they changed bus but he found the bag missing when they arrived at the Inanam City Bus Terminal.
The bag contained among others a set of army uniforms, a bell, two pairs of shoes, towels and documents.
In other cases, a cell phone shop was ordered to pay RM860 within 14 days to one Mohd Afendy Ali, 19, for not paying compensation to a Sony Ericson (X-Periax2) cell phone to Afendy.
Afendy told the court that he purchased the cell phone with 3G function from the I-phone Communication Sales and Service Tawau shop for RM860 on Jan 5, this year and found the 3G was not functioning at all in making video calls.
He brought back the tool to the shop the next day as he felt unsatisfied.
However, he was told by the salesman that the cell phone has 3G function.
"I intend to buy a 3G cell phone but it would not worth for me to pay such amount of money if the 3G of the cell phone was not functioningÉ I requested the shop to pay back the compensation but they refused with the reason of loss for receiving used cell phone," Afendy said.
The report revealed that the tool was still kept at the shop since Afendy brought it back to the shop on Jan 6, this year.
Thien said the shop could only continue keeping the handphone once Afendy has received such amount of money from him.
