Pakistani with local wife and kids is charged

Kota Kinabalu: A Pakistani trader was charged in the Sessions Court, Tuesday, with causing the death of a 16-year-old girl in Kota Marudu last month.Amir Ali Khan Nawaty, 40, of Buner, Pakistan, is accused of causing the death of Norikoh Saliwa between 11am and 12.30pm on Nov 25 this year inside a moving lorry headed from Kota Marudu town to Langkon, at Km 2.8 along Jalan Kota Marudu-Langkon.Amir, who had lived here since 10 years ago, pleaded not guilty before Judge Duncan Sikodol after the charge was read to him in Bahasa Malaysia.ADVERTISEMENT He faces a jail sentence of up to 10 years, or with a fine, or both if found guilty under Section 304(b) of the Penal Code.Sikodol set Feb 7- 8, 2013 for trial and fixed Jan 14, 2013 for case management. Amir was denied bail.Sikodol ordered Amir to be remanded further due to the seriousness of the case, public interest and that he is a foreigner, hence a high possibility that he would abscond and also for his own safety.Earlier, Deputy Public Prosecutor (DPP) Raja Zaizul Faridah Raja Zaharuddin who appeared together with DPP Luke Ressa Balang, objected to bail for Amir on the grounds that the case was classified as public interest as it has attracted attention.ADVERTISEMENT Amir who married a local and has two children, requested bail and his wife as his surety, claiming that his passport is valid for 10 years."The lengthy imprisonment imposed under the Section reflects the seriousness of the offence. There is high possibility that if bail is granted Amir will abscond before the trial date.

"Amir is not a Malaysian. He is a passport holder and is now being investigated for an immigration offence," said Raja Zaizul."If the court grants bail and he surrenders his passport pending the trial date, the possibility of him absconding is still high."According to the investigating officer from Kota Marudu, the public in Kota Marudu is angry with Amir's act and if the court grants bail to him, and he is released, he will surely abscond due to the fact that the public there is now after him," she said.Stay up-to-date by following Daily Express’s Telegram channel.

Raja Zaizul also applied for the case to be heard in the Sessions Court.Raja Zaizul also informed the court that all the witnesses are in Kota Marudu and suggested the trial to be held here. Amir was not represented.
