Man jailed and fined for robbing woman

Kota Kinabalu: A 28-year-old jobless Kadazan man currently serving four years' jail for robbery was on Friday sentenced to another seven years' jail and fined RM5,000 by the Sessions Court for robbing a woman.Donald J. Molison pleaded guilty before Judge Azreena Aziz to robbing one Michele R.D. Godomon, 25, of a wallet containing her personal documents and a handphone and also tried to assault her by shoving her to the ground at 6.50pm on April 21 this year at Jalan Kiulu, Kg Kionsom in Tamparuli.

Donald was jailed seven years effectively from Friday and fined RM5,000 or six months' jail.

Earlier, Donald who was not represented, requested for leniency and told the court that he is willing to pay a fine to reduce the imprisonment sentence as he wanted to rebuild his life and help his family.

Deputy Public Prosecutor Chow Siang Kong, urged the court to impose a deterrent sentence due to the seriousness of the offence and the fact that Donald had used force against Michele and also asked the court to take into account the frequency of the offence as well as the public's interest.

Chow in tendering Michele's impact statement, said she is frightened to drive alone and worries for her safety if Donald were released from prison soon.

The court also heard that Donald has three previous convictions for robbery, vehicle theft and taking drug for which he was jailed four years, one year and four months, respectively.

Chow in submitting the facts of the case orally, said Michele was driving when suddenly her car was hit from behind by another car driven by a man.

Michele went down to check for damages and at the same time the driver of the other car later identified as Donald also alighted from his car and approached Michele and pretended to negotiate with her.

Then Donald suddenly grabbed Michele's handphone and shoved her to the ground. He then went to Michele car, opened the door and took her handbag and fled the scene in his car.

Chow said Donald was arrested by police at Jalan Burung Selingkir in Inanam and that police found Michele's wallet containing her personal documents in the knapsack seized from Donald when he was detained.

Michele identified Donald during an identification parade conducted by police.

Donald committed the offence under Section 392 of the Penal Code which carries a jail term of up to 14 years and liability of a fine or whipping on conviction. – Jo Ann Mool
