Rape suspect's arrest warrant revoked

KOTA KINABALU: The Sessions Court on Monday revoked the warrant of arrest for a 52-year-old lorry driver charged with raping a 15-year-old girl.Judge Ainul Shahrin Mohamad made the order on Lodinus @ Harry Langap, a Dusun, when his case was brought up for mention.

In revoking the arrest warrant, Ainul said there was a miscommunication which led to the issuance of the warrant against Lodinus.

On Sept 4 this year, the court had issued the warrant of arrest for Lodinus.

Earlier, counsel Erveana Ansari who represented Lodinus told the court that on the day the warrant was issued, the prosecution had agreed to vacate the trial date, hence she had informed her client not to come on the said day.

She also submitted that she was present in court for another case on the said day but the Deputy Public Prosecutor (DPP) did not contact or inform her regarding the case.

Meanwhile, in replying Erveana, DPP Nartiah F. M Sambatan said she (Erveana) could have checked online through the Case Management System regarding the case.

Lodinus pleaded not guilty to raping the underage girl at 7pm on Sept 15, 2013 at Kg Mentanam in Kota Belud.

The offence under Section 376(1) of the Penal Code carries a jail term of up to 20 years and whipping, on conviction.
