Indonesian gets 25 years

TAWAU: A 30-year-old Indonesian labourer was jailed 25 years by the High Court on Monday for causing the death of a taxi driver over a RM20 fare, three years ago.Judicial Commissioner Azhahari Kamal Ramli handed the sentence to Hamzah Yunus @ Mohamed Yunus who pleaded guilty to an amended charge of committing culpable homicide not amounting to the murder of one Marsuki Pade, 44.

The crime took place between 8.30pm and 9pm by the roadside near the Tawau Golf Club, here, on June 8, 2011.

The offence under Section 304 (a) of the Penal Code carries a jail term of up to 30 years, on conviction.

Deputy Public Prosecutor Kamalia Yahdi who appeared for the prosecution, said on that day Hamzah who wanted to go to his uncle's house had stopped a taxi driven by Marsuki.

Before entering the taxi, Hamzah asked for the fare and Marsuki had agreed to RM15.

Kamalia said upon arriving at the said place, Hamzah gave Marsuki RM20 but Marsuki refused to give him the RM5 balance leading to an argument between them.

An upset Hamzah then took a hammer from inside the taxi and assaulted Marsuki.

Marsuki's body was found inside the taxi parked near a garbage collection centre.

The court ordered Hamzah referred to the Immigration Department after completing his jail sentence.
