Forging document: Woman, 3 brothers to enter defence

KOTA KINABALU: A woman and three civil servant brothers were called to enter their defence on charges of forging a family property transfer form and thereafter using the document as a genuine document 15 years ago.Sessions Court Judge Azreena Aziz fixed Nov 3-4 this year for Levita Micheal @ Levita Lojunang, 53, Claudeus Moikon, 53, Julius Moikon, 55, and Jeremy Moikin, 41, all Kadazans, to enter their defence. Azreena ruled that the prosecution had established a prima facie case against them.ADVERTISEMENT Levita allegedly forged one Lonjuning Moikon's thumbprint on the form for the purpose of having the land title registrations, N. T 2066, N. T 6601 and N. T 8365 at Kg Kibabaig, Penampang transferred to the three brothers at 9am on March 3, 1999 at the Native Court in Penampang. The charge stated that Levita had used the document to cheat.The brothers are accused of using the fake document at the same place and time.They were jointly charged under Section 471 of the Penal Code punishable under Section 465/34 of the Penal Code which carries a jail term of up to seven years and liability of a fine, on conviction.ADVERTISEMENT Meanwhile, Azreena also ordered Levita to enter her defence on an alternative charge of allegedly falsifying a will which was an inheritance letter on three plots of ancestral land in Kg Kibabaig, Penampang for the purpose of transferring the land ownership to the three siblings. The prosecution had called 18 witnesses during the hearing.

Counsel Zahir Shah who represented the brothers and Levita informed that more than 10 witnesses would be called during the defence.Deputy Public Prosecutor Ernie Effiza Idris conducted the prosecution.
