Foreigner gets five years, 2 strokes for having knife

LAHAD DATU: A 39-year-old foreigner was jailed five years and ordered given two strokes of the cane for having a 20cm long knife.Sessions Court Judge Steve Ritikos who sat as a magistrate handed the sentence to Simaon Pomicpic after he pleaded guilty to carrying the dangerous weapon in public.

He committed the offence at 11am on Oct 2 at Mile 1√ in Jalan Dam, here.

Simaon was charged under Section 6(1) of the Corrosives, Explosive Substances and Dangerous Weapons Act 1958.

According to the fact of the case, Simaon was detained on October 2 after a 78-year-old woman lodged a police report stating that the accused had entered her shophouse.

The woman said during the incident, Simaon entered her shop and told her that he was being chased by someone.

She told the accused to leave. Instead, Simaon went to the back of the shophouse and entered the kitchen although the woman's husband tried to block it.

The incident was witnessed by their maid who immediately informed the couple's son.

Upon reaching home, the couple's son and his friend tried to calm the accused and asked him to leave.

The accused, who was holding a knife, refused to do so and was apprenhended by the son and his friend.

During the struggle, the accused suffered minor injuries and was subsequently handed over to the police.

Simaon was ordered referred to the Immigration Department upon completing his jail sentence.

Meanwhile, in SANDAKAN, a 24-year-old Indonesian who stole two tyres from his workplace was sentenced to seven months' jail and his 19-year-old Indonesian wife was jailed six months for abetting him.

Eddi Pius and his wife Maslina Dominikus admitted before Magistrate Suhailla Selag to committing the offence at 8.26pm on Oct 15 at the workshop of a tyre company at Mile 10.

ASP Tan Hiap Wah, prosecuting, told the court that the couple's action was seen through the closed circuit television.

Eddi was charged under Section 381 of the Penal Code while Maslina was charged under Section 109 of the Code.
