Motorist jailed and fined for causing death

KOTA KINABALU: A 32-year-old local was sentenced to three years' jail and fined RM8,000 or three months' jail by the Traffic Court after he was found guilty of dangerous driving which led to the death of a motorist two years ago.Lias Ungas was convicted of driving a Mitsubishi Storm vehicle in a dangerous manner which resulted in the death of motorcyclist, Allan Jr. Stephen Tuning, 27, at 8.10am on Oct 24, 2012 at Lorong Sena, Jalan Luyang, here.Magistrate Stephanie Sherron Abbie also ordered Lias to pay a compensation of RM5,000 in default six months' jail to Allan's family.

Abbie also ordered Lias' conviction to be endorsed on his driving licence and disqualified him from holding or obtaining a driving licence for three years. Lias, however, managed to obtain a stay of execution pending an appeal to the High Court.He had, on Sept 30, 2013, claimed trial to the charge under Section 41(1) of the Road Transport Act, which carries a jail term of between two and 10 years and a fine of between RM5,000 and RM20,000, on conviction.

The court ruled that Lias, who testified under oath for his defence on Aug 29 this year, failed to raise any reasonable doubt against the pros,ecution's case.Eight prosecution witnesses and two defence witnesses, including Lias, testified throughout the trial which commenced on May 14 this year.

It was revealed during the trial that he fatal accident occurred due to Lias' negligence while overtaking a car ahead of him, dangerously causing him to collide with the motorcyclist.Stay up-to-date by following Daily Express’s Telegram channel.

Allan suffered severe injury and was rushed to the Queen Elizabeth Hospital II for treatment but pronounced dead at 4.06pm the same day.Traffic prosecuting officer Insp. Hanif Mamyudi prosecuted while Lias was represented by counsel Serena Liew. – Jo Ann Mool
