Having pistol, bullets: Hearing tomorrow on Filipino's appeal

KOTA KINABALU: The High Court will hear tomorrow (Dec 19) the appeal by a Suluk Filipino against his sentence on three counts of illegally having a pistol, live bullets and a modified knuckle-duster.Judge Stephen Chung set the date for Alasbin Abdul Mahadi, 26, following a request from his counsel for a written submission.The court also fixed the same date for an appeal by the prosecution against the inadequacy of sentence imposed on Alasbin.

Alasbin had, on Oct 2 this year, pleaded guilty to all charges at the Sessions Court where he was sentenced to seven years and six lashes of the cane on the first count of having an Armscor pistol at 1.40am on Feb 6 this year in a car at Mile 7, Jalan Tuaran.On the second count, he was jailed one year for having eight live bullets at the same place and time while on the third count, he was handed one year's jail plus one stroke of the cane for having a modified knuckle-duster at the same place and time.Alasbin, who was also jailed five months and one stroke of the cane for illegal entry, had been ordered to serve the sentence concurrently. He was represented by counsel Chong Kian Ming, while Deputy Public Prosecutor Afzan Abd Kahar appeared for the prosecution. Meanwhile, the case of a 24-year-old man charged with drug trafficking has been transferred to the High Court.

Magistrate Faiz Omar granted the prosecution's application to transfer the case of Wong Foo Nyen.Self-employed Wong is accused of trafficking 72.09gm of syabu at 3pm on Aug 19 this year at a car park at Block E, Grace Court Apartment in Sembulan.

The offence, under Section 39B of the Dangerous Drug Act 1952, carries the death sentence on conviction. Heng Hak Kweng allegedly committed the offence at 11.30am on Dec 15 in a hotel lift in City Mall here.He was offered bail at RM3,500 in two sureties pending mention on Jan 13. Inspector Syahrin Ali prosecuted.
