Datuk jailed 3 months for sending threats via SMS

Putra Jaya: The Court of Appeal here has sentenced businessman Datuk Dr Ahmad Ramzi Mohamad Zubir to three months' jail for sending threats via the short messaging service (SMS) to three former Barisan Nasional elected representatives and defaming a former senior private secretary (SUSK) of the Terengganu Menteri Besar in 2009 by using his telephone number to send the sms. A panel of three judges headed by Court of Appeal president Tan Sri Md Raus Sharif was unanimous in the decision after allowing the prosecution to appeal against a High Court decision to acquit and discharge Ahmad Ramzi. Ahmad Ramzi, 43, a former Terengganu Menteri Besar's political secretary was earlier sentenced to a year's jail by the Sessions Court before he appealed to the High Court. ADVERTISEMENT After hearing the appeal, Ahmad Ramzi who was represented by Hisham Teh Poh Teik Abdullah in the proceedings today, was sentenced by the Court of Appeal to three months' jail for each offence which would run concurrently starting Friday after the three judges rejected his application to postpone the sentence. In the judgement read by Justice Datuk Wira Mohtarudin Baki, the court found the High Court judge had erroneously discharged and acquitted Ahmad Ramzi on Dec 29, 2013. Justice Mohtaruddin said the High Court did not evaluate the statements of all witnesses comprehensively and only depended on the defence statement of Ahmad Ramzi that his router was faulty at the time. He said the prosecution had from the onset succeeded in creating doubts in the Ahmad Ramzi case and found that the Sessions Court was not erroneous when it found Ahmad Ramzi guilty on all charges. ADVERTISEMENT He added that the Sessions Court also fulfilled all elements required in both charges against Ahmad Ramzi. – Bernama In June 2009, Ahmad Ramzi was accused of threatening three former state assemblymen namely Mohd Ariffin Abdullah of Paka, Abd Halim Jusoh of Permaisuri and Datuk Rosol Wahid of Ajil at Kampung Kubang Parit here between 11.21 pm and 11.25 pm on April 13, 2009.

The accused had also allegedly defamed the former SUSK of Terengganu Menteri Besar by using the mobile phone number belonging to Wan Ahamad to send the threatening SMS. For the offence, Ahmad Ramzi was guilty under Section 507 and 505 of the Penal Code which provides for a jail sentence of not exceeding two years or fine upon conviction. - Bernama
