Kota Kinabalu: The High Court Registrar of Sabah and Sarawak, Ismail Brahim, said the Court is equally concerned with the matters raised in the Daily Express front page report entitled 'Green Lung Gone; Human Lungs Affected' (March 5)."However, we wish to state that the project is managed and supervised by the Legal Affairs Division of the Prime Minister's Department, the Project Consultant and the appointed contractor," Brahim said in a statement.

"We are therefore in no position to respond to the environmental issues raised in the reports," Brahim concluded.

Unhappy members of the public first called the Daily Express and raised the alarm about the massive chop-up of the popular Bukit Shariff Osman and its towering trees. Many KK folks regarded as an iconic green beauty or cherished as "the only green lung of Luyang".

As always, the Daily Express responds invariably to such public interest.

An onsite investigation discovered a second shock – prominent residents of nearby Taman Jasmin fuming about severe dust contamination from penetrating dust storms which invade beds, bed sheets, pillows, kitchen, food, dining tables, smearing every single items inside their mansions built in the 70s and blamed either feeble or non-existent mitigation measures to contain the dust invasion.

For example, long stretches of bare slopes left uncovered despite legally required to do so under the Sabah Environmental Protection Enactment 2002, Part III, Item 20 (i), thereby exposing huge surfaces of loose soil to strong winds as in the current dry season or heavy downpours causing mud to invade Jalan Kebajikan between the project and their housing, with inches of mud, they vented their displeasure.
