Labuan couple to sue Water Dept over 'trespass'

Labuan: A couple intend to file a suit seeking an injunction to restraint the Labuan Water Department (JBA), Labuan Corporation (LC), Majlis Perbadanan Labuan and a third party contractor from entering their land and a declaration that the land is not being acquired by the Government. The parcel of land (Lot 205222199) located in Kg Nagalang was bought by Ong Ai Lian and Goh Han Boo on May 29, 2009. They had applied to LC to build a house on the land.

However, JBA objected to the plan on the grounds that it was too close to the Kerupang Dam.Ong, speaking through her lawyer JM Martin, claimed that JBA stated that it had decided to take back the land."I had not received any letter or notice in virtue of the Land Acquisition Act 1960. On September 25, 2014, LC granted me permission to build a house of not more than 1,050 square feet."On February 2, 2015, Ong expressed shock that a third party contractor had trespassed into her property with a bulldozer to clear the land.

She instructed her lawyer to call JBA on March 23 and was informed that the exercise was for the purpose of land surveying.Stay up-to-date by following Daily Express’s Telegram channel.

Perplexed, JM Martin called up the Land Office, which confirmed there was no record of government intention to acquire the said land.

The court action also seeks a declaration that the land belonged to Ong and Goh and the Government has no intention to take over the land under the Land Acquisition Act 1960.
