Cops: Action on anyone found at barred venues

Kota Kinabalu: State CID Chief SAC Datuk Salehhudin bin Abd Rahman said anyone found patronising or loitering at Padang Merdeka during the illegal May Day rally on May 1 will be booked by police.He said the onus would be on these individuals to prove the reasons for being present at the venue this Friday.

"City police have obtained a court order that prohibits anyone, including Bersih Sabah and the organisers from holding the rally.

"Those found not abiding by the order will face legal action including spectators or anyone present at the scene.

"The burden will be on those individuals, who may be caught for being at the venue, to prove what they are doing there, whether they are members of the rally or not. The onus is on them to prove their innocence," he said.

Salehuddin, who is acting State Deputy Police Commissioner, said this after he handed over duties to Dato' Awang Sahari bin Em Nadzeer witnessed by the State Police Commissioner Dato' Jalaluddin Bin Abdul Rahman at the Sabah police headquarters in Kepayan on Tuesday.

Jalaluddin also witnessed the handing over of duties for the post of State Special Branch Chief by ACP MD Zainal bin Rahmat to SAC Dato' Rorete@Clarence Rorote Ak Sagon who was formerly Sarawak Police Special Branch Deputy Chief.

Sabah Police Family Association (Perkep) Chairman Datin Siti Aishah binti Harun witnessed the handing over of duties for the post of Sabah Perkep Vice-Chairman by its acting Datin Noridah Nordin to Datin Fatimah Binti Awang Dahlan.

Salehuddin reiterated that no one should be at the town field on May 1 for any reason.

On whether policemen would be stationed at the venue, he said it would depend on information gathered by its intelligence.

To a question, he said the force has sufficient manpower to ensure order and peace prevail this Friday.

City Police Chief ACP M. Chandra had earlier advised people not to take part in the rally and warned that those who failed to abide by the court order can be charged under Section 188 of the Penal Code for disobedience and can face up to six months in prison or fined up to RM2,000 or both, upon conviction.

Chandra said organisers could also be pulled up under Section 9(1) of the Peaceful Assembly Act and can be fined up to RM10,000.

He said a court order was obtained to stop Bersih Sabah and 35 non-governmental organisations from staging the May Day rally scheduled to take place at Padang Merdeka on May 1.

Chandra said five locations – Padang Merdeka, Taman Chong Thien Vun, City Park, Seagam Waterfront and Dataran Bandaraya as well as their surroundings and the names of 16 individuals identified as organisers were listed in the restraining order under Section 98 of the Criminal Procedure Act (Act 593) which took effect from April 27 until May 3.

Earlier new State Deputy Police Commissioner Dato' Awang Sahari bin Em Nadzeer who had served in the force for over 30 years said his last post was as Bukit Aman Deputy Director for Forfeiture of Properties, Legal and Detention Division under the Narcotic Crime Investigation Department before being posted here.

Awang Sahari who comes from Membakut, said he served about 30 years in the special branch, seven years in commercial crime and four months in the Narcotic Crime Investigation Department.
