45 years for raping niece, 9

KOTA KINABALU: A 54-year-old local was sent to prison for 45 years for raping his nine-year-old niece. Sessions Court Judge Noor Hafizah Mohd Salim meted out the sentence to the man who admitted to two counts against him on Wednesday.
On the first count, the man was jailed 20 years for raping the pupil at 2.20pm in November 2018 at a house in a village of Kota Belud.

On the second count, he was sentenced to another 25 years’ jail for repeating a simillar offence against the same victim at 2pm on Match 7, this year at the same place.
He was charged under Section 376(3) of the Penal Code which providea for a jail term of between eight and 30 years, and whipping at least 10 strokes, on conviction.
The court ordered the man to serve the jail sentence consecutively from March 7 this year as the offence committed by the man was different time and repeated.
No whipping was imposed to him due to his age.

In asking for leniency, the man who was not represented told the court that he regretted his wrongdoing.
However, Deputy Public Prosecutor Lim Sze Chuen urged the court to hand down a deterrent sentence on the grounds that it was a serious offence against a minor who has relation to the accused person.

Lim added that the court should consider that the victim had traumatised with the incident.
The court heard that the incident came to light after the second rape case took place when the victim revealed it to her sister.
The sister then told their mother who then lodged a police report on March 7 claiming that her nine-year-old daughter was raped by her uncle two times.
Further investigation on the same day at 1.30pm while the victim was playing with her two other siblings, the man whose house next to the victim’s house, asked her to come to his house.
The victim had just followed the man to come in to his house where he raped the victim. During the incident, the victim’s siblings were ordered to wait outside the house.
After raping her, the man warned her to not tell others about the incident and also gave her RM2 before she left the house.
But the victim had revealed the second incident to her sister.
