181ha in Papar alienated for sports complex
A TOTAL of 181.299 hectares (448 acres) of the State Grazing Reserve land at Kampung Kawang and Kampung Peranggi in Papar have been alienated for the proposed construction of  the Papar Sport Complex and Construction Industry Development Board (CIDB) Training Complex as well as for villagers.Chief Minister, Datuk Seri Mohd Shafie Apdal, said the status of that portion of the grazing reserve was dissolved through GN.83/2017 dated on April 6, 2017. “A total of 129.2 hectares (319 acres) are earmarked for the use by people of Kg Kawang and Kg Beringgis,” he said in reply to the Kawang Assemblyman when winding-up at the State Legislative Assembly sitting. He said Kg Seri Menanti covering 9.88ha (24.4 acres) had been gazetted as the village’s Native Residential Reserve land under GN.263/2017 on Aug 24, 2017, whilst seven proposed villages are still being studied by the State Government. On the land applications, raised by the Kemabong Assemblyman, that has yet to be processed since the 80s, Shafie said the Government through the Land and Survey Department will always give priority to speed up land applications by local people. For Tenom, including Kemabong, he said there are 3,115 land applications still pending until March 30 this year.

A total of 135 lots of Native Title (NT) lands involving 454 hectares have already completed surveying works last year, he said, adding that 175 NT titles have also been issued for Tenom,   On the Sabah Land Development Board’s (SLDB) application for 6,079 acres in Rundum, Kemabong, Shafie said the application had been rejected by the Tenom Land Utilisation Committee and the land inhabited and worked on by local villagers there will be surveyed by the Land and Survey Department through the Pantas programme. The Chief Minister also responded to the Matunggong Assemblywoman who raised the customary  and village reserve lands within the Borneo Samudera Sdn Bhd area.

“I am happy to announce that Kg Pinawantai, Kg Pomonsukan, Kg Radtak “A” and Kg Radtak “B” have already been alienated from Borneo Samudera and had been gazetted as native residential sites under Section 78 of the State Land Ordinance, involving 113.23 hectares (279.79 acres),” he said.

He said the State Government’s stand on the matter is clear that government-linked companies (GLCs) must give consideration to villagers who have long inhabited the said land. The same goes to forest reserve areas which have been inhabited by local villagers where if it is suitable and they have strong basis, the area involved will be distributed to the villagers concerned, he said. On another issue raised by the Matunggong Assemblywoman on the status of the Rungus Community Cultural Centre at Pinawantai, Shafie said a site involving 13.593ha has been gazetted through GN. No 765-2012 under Section 28 of the State Land Ordinance on July 13, 2012, where it is being managed by the Tourism, Cultural and Environment Ministry. If there is encroachment on the land, he said the Ministry concerned would need to deal with it and propose the best solution.

“The Rungus Community Cultural Centre site at Pinawantai is a proposal at the village-level. The  Land and Survey Department has yet to receive any land application for this purpose,” he said. Replying to the Kuamut Assemblyman who raised on the status of the Pinangah Forest Reserve area which has been alienated, Shafie said 3,000ha which has been alienated from the forest reserve area concerned on July 30, 2017, is the Sungai Mangkuwagu Forest Reserve.

He said the State Government through the Land and Survey Department will do a surveying through the Pantas programme for 1,700ha which had been inhabited by local villagers for the purpose of  issuing NT titles. He said the Government plans use those areas still unexplored for the socio-economic development for the local people.

On the Communal Title at Tandek and  Kg Natu, Polipikan and Talas land issue raised by the Tandek Assemblywoman, he said the Communal Title will be revoked through a land title sub-dividing method.

“The plan to distribute lands for two Communal Title in Tandek area has been approved. The surveying works for sub-dividing the  lots will be implemented to enable issuance of individual NT titles to all beneficiaries involved before the end of 2020,” he said.

He said the two approved Communal Titles for Tandek which has been approved for proposed sub-division  are Sungai Magandai Communal Title and Sonsogon Communal Title, adding that the surveying works for the Sonsogon Magandai Communal Title will be implemented by the Land and Survey Department while for the Sg Magandai Communal Title will be done by a contractor which has been given approval to do the land clearing works. “Timber log clearing in Communal Title area is still allowed with permission from the beneficiaries and the State Government through the Natural Resources Secretary. Through an agreement between the contractor  and beneficiaries, the villagers will get infrastructure benefits like road construction which is to be decided in the agreement between both parties.                                 – Larry Ralon

“For the Government, this will speed up the lots surveying works through the appointment of licensed surveyors with the costs borne by the contractor. The clearing works in Communal Title aread  will not jeopardise the Government’s aspiration and effort to issue individual titles to the beneficiaries,” he said. To another question from the Tandek Assemblywoman,  Shafie said Land and Survey Department record showed the land issue at Kg Natu, Polipikan and Talas involved 251 NT titles which have been issued to natives who then subleased it to a company, Peilipikan Plantation Sdn Bhd, for a period of 30 years (2009-2039) and thus there is no issue about taking back the land concerned, considering that the ownership of those lands still belongs to the natives. –Larry Ralon
