Bribery: Three cops to enter defence
Kota Kinabalu: Three police personnel who were charged with asking and receiving bribes were ordered to enter their defence on their respective charges by the Special Corruption Court, here, Friday.

Judge Abu Bakar Manat made the order on Inspector Mohd Faiz Mohd Yusof, 33, and Corporals Elly Boniface Sie @ Siu Tugok, 39, and Liza Ambau, 40, ruling that the prosecution had succeeded in proving a prima facie case against all of them on the charges.

He set June 24-26 for the trio’s defence.

Counsel Luke Ressa Balang, representing the three, informed the court that they would be giving their defence under oath.

Faiz are facing three charges, while Elly and Liza one charge each.

Faiz, on the first count, is accused of asking a RM6,000 bribe from one Wong Kian Shung as inducement to not take action against one Dahlia Andreas who tested positive for drugs.

He allegedly committed the offence between 11pm and midnight on April 8, 2016 at Penampang police station.

On the second and third counts, Faiz allegedly accepted bribes of RM2,000 and RM1,000 from one Zaleha Brahim as inducement to not take action against one Rinciah Labik who also tested positive for drugs.

The offence allegedly took place on Feb 9 and 10, 2016 at a car park near a restaurant in Donggongon town.

Elly and Liza are accused of soliciting a bribe of RM6,000, respectively, from Wong for the same purpose as Faiz, between 11pm and midnight on April 8, 2016 at Penampang police station.

Faiz’s first charge as well as Elly’s and Liza’s were framed under Section 16(a) (B) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 and punishable under Section 24 of the same Act, which carries a jail term of up to 20 years and a fine of not less than five times the sum or value of the gratification which is the subject matter of the offence or RM10,000, whichever is higher, on conviction.

Faiz’s second and third counts are framed under Section 17(a) of the MACC Act 2009, which is punishable under Section 24 of the same Act.

The three were all released on an extended bail.
