Legal action against Federal Govt

Kota Kinabalu: CM Datuk Seri Mohd Shafie Apdal has dismissed legal action as one of the options to resolve the issue of State revenue claims from the Federal Government.

“We will not drag the Federal Government to court as I am confident this is not the right move to take in our efforts to get our claims,” he said to a supplementary question by Tambunan Assemblyman Datuk Dr Jeffrey Kitingan.

“There are many other options to claim our revenues.” Shafie said this is a complicated matter and any initiative has to be taken in line with the government’s current efforts.

“I have instructed the Finance Ministry and Economic Planning Unit to look into this matter and there are several issues that we had agreed upon during a recent meeting.

“However, it is best if the Prime Minister announces this mutually agreed issue,” he said. 

Noting that the claims had been long overdue, Shafie said it should have been resolved earlier as it is one of the matters which had been enshrined in the Federal Constitution.

“The Constitution is the mother of all agreements in the formation of Malaysia and I am aware that it is not easy to administer this country…that is why I have asked for the figures and details from State and Federal agencies.

At the State level, we have our own approach to study this issue thoroughly as revenue collection involves taxes, the Customs Department, Immigration Department and other agencies to identify the actual revenue that we can receive from the Federal Government.”

Earlier, to a question by Jeffrey, Shafie said the State Government has submitted a guideline draft to the Federal Government on the re-structuring of the special grant.

He said, at the moment, the State Government is still waiting for the feedback from the Federal Government. 

“Thanks to the good ties between the State and Federal Governments, and coupled with the will of the State Government, I believe the efforts to claim our revenues will bear a positive result soon,” he said.
