Hitting his wife with a torchlight: Man freed

KOTA KINABALU: A 35-year-old man was given a discharge not amounting to an acquittal (DNAA) from a charge of assaulting his wife using a torchlight.

Sessions Court Judge Noor Hafizah Mohd Salim gave the DNAA to Felik Krutok when the instruction from the Deputy Public Prosecutor (DPP)’s office was received.

Felik was accused of hitting his wife using the DP LED torchlight at 7pm on April 21 this year at a house in Kg Mandalipau, Papar.

The offence, under Section 324 of the Penal Code and read with Section 326A of the same Code, provides for a jail term of up to 20 years, and with fine, or with whipping, or any of two such punishments.

Earlier, DPP Mohd Ali Imran told the court that he received instruction from his superior to apply for DNNA in Felik’s case.

The court was informed that the complainant (wife) lodged a police report to withdraw the earlier police report against Felik.

In another case, a 21-year-old was jailed five years for taking syabu for the third time.

Sessions Court Judge Elsie Primus handed the sentence to Iskandar Yahya who admitted to the charge against him.

He was also handed a stroke of the cane as well as placed under police supervision for three years after completing his sentence.

The court ordered Iskandar to serve the jail sentence from the date of his arrest.

He was found taking the drug at noon on June 11 this year in Likas after testing positive for the drug.
