Anti-Islam comment: Accused for Oct trial

KOTA KINABALU: A 28-year-old technician charged with uploading and making offensive comment on Prophet Muhammad will go trial on Oct 23, 29 and 30.
Sessions Court Judge, Noor Hafizah Mohd Salim, set the date for Mohd Sharulnizam Stanley Sigan after being informed by the prosecution that the representation letter was dismissed and trial will proceed.

On the first count, Mohd Sharulnizam is accused of uploading a comment through the Mobile Legend application under a profile name “Bakakuk” at 11.48pm on Feb 26, this year.
The charge stated that the comment was likely to cause religious disharmony between Muslims and non-Muslims.
The offence under Section 298A (1)(a) of the Penal Code provides for a jail term of between two and five years, upon conviction.
On the second count, Mohd Sharulnizam allegedly made and initiated the transmission of the comment with the intent to annoy the public at 1am on Feb 27, this year at Taman Kinarut, Papar.

For the offence, he was charged under Section 233(1)(a) of the Communications and Multimedia Act 1998 which carries a jail term of up to a year, or a fine of up to RM50,000, or both, upon conviction.
Deputy Public Prosecutor Megat Mahathir Megat Tharih Affendy appeared for the prosecution while counsel P.J Perira represented Mohd Sharulnizam. – Cynthia D Baga
