Woman acquitted of causing friend’s death

KOTA KINABALU: A 30-year-old woman was freed from a charge of causing the death of her friend by negligence in Inanam.
Vivien Jane Julian was discharged and acquitted by Magistrate Afiq Agoes on Friday without her defence being called.

Vivien was accused of negligently causing the death of one Lisabilah Dulima, 29, at 6.30pm on July 6, 2017 along Jalan Tuaran Bypass in Inanam, here.
She claimed trial on April 3, 2018 to the charge under Section 304A of the Penal Code which carries a jail term of up to two years, or fine, or both, on conviction.
The prosecution had called seven witnesses throughout the trial.
The court also ordered Vivien’s bail of RM3,000 be refunded back to her.

Vivien was represented by counsel Lindsay Michael and Batholomew Jingulam.
In another case, a 17-year-old boy claimed trial to assaulting a man in here.

The boy allegedly committed the offence at 1.30am on Oct 12 at the roadside near Eden Heights here.
The offence under Section 323 of the Penal Code provides for a jail term of up to a year or fine or both conviction.
The court set Nov 7 for mention at the Court for Children and released the boy on a bail at RM500 with his parents as sureties.
Meanwhile, a man from Thailand charged with assaulting a man with a knife, will have his case mentioned back on Nov 15.
The court fixed the date for Sriboonjit Jirawat.
Sriboonjit, 25, was accused of committing the offence against one Yakub Abdullah at 9.50am on July 27, at the emergency staircase of Block 1, at the Api-Api Centre here.
He had on July 31 pleaded guilty to the charge under Section 324 of the Penal Code.
