Man jailed and caned for raping teen cousin

Kota Kinabalu: A 28-year-old man who raped his underaged cousin while he was under the influence of drugs, was jailed 13 years and ordered given two stroke of the cane.Sessions Court Judge Noor Hafizah Mohd Salim handed the sentence to the man who pleaded guilty to the charge against him on Tuesday.

The man had raped the 15-year-old girl at 3.42pm on July 25, 2017 at a house in Manggatal, near here.
The offence under Section 376(1) of the Penal Code carries a jail term of up to 20 years, and whipping, on conviction.
During mitigation, the man who was not represented asked for leniency saying that he was very remorseful, confessed his wrong doing and promised to be a better person in future.
He said because of the drug, he lose control himself and raped his cousin adding that, since two years he had been stayed with the victim’s family, he never ‘disturb’ the family.

According to the man, he was working at a cyber cafe and that his mother is sick while his father has passed away.
However, Deputy Public Prosecutor Megat Mahathir Megat Tharih Affendy urged the court handed a deterrent sentence on the grounds that the man had committed a serious offence against the girl who is also the man’s cousin.

Megat said by pleading guilty it is not a reason for the man to get a lesser sentence.
The court heard that the incident happened while only the victim and the man were at home.
While the victim at her room, suddenly the man entered her room and raped her.
