Inmate murder: Prisons inspector, 9 wardens face death
KOTA KINABALU: Ten prison personnel, including an officer, were charged in the Magistrate’s Court here Tuesday with the murder of an inmate at Kepayan Prison.

Prison Inspector Dzulfikri Mohd Safri, 28, and wardens Barry Jipmon, 30, Farizan Mokri, 40, Mohd Saiful Saidin, 34, Amran Yasik, 25, Ab Mutalib @ Talib Abd Rasul, 40, Zerry Maidin, 33, Tomy Momoh, 36, Shahryll Nazry Wan Sofian, 25, and Muhammad Fazi Lakui, 32, were brought before Magistrate Lovely Natasha Charles.

They were jointly accused of murdering Shainal Mukhtar, 36, in a cell of Gemilang Block, at Kota Kinabalu Central Prison, Jalan Kepayan near here at 4.30pm, on Oct 4.

However, no plea was recorded from the 10 after the charge under Section 302 of the Penal Code, was read out to them.

Senior Federal Counsel Khairul Anuar Abdul Halim, prosecuting applied for another mention date pending the chemist’s and forensic reports.

Lovely set Nov. 25 for mention of the case. She ordered all accused to be remanded further as the charge framed against them has no provision for bail. The 10 were represented by counsel PJ Perira, Ariel Dasan, Hairul V. Othman and Dominic Chew.

It was reported that the prisoner who had been in jail for the past two years for drug related offences, was found unconscious in his cell while the post-mortem report found that the inmate died due to blunt trauma to the head, and there were also bruises visible on his head and body.

Shainal was taken to the Queen Elizabeth Hospital, where he was confirmed dead.

In another case, 12 people were penalised for committing drug-related offences.

Md Hanaffie Abd Wahab, Soo Kin Wah, Alsun Usman, Rujinah Marudin, Hapi Daimun, Voo Ken Kiong, Arde Zaimin, Jinimal Jain, Md Nazrul Jemin, Samman Salip, Kelson Chong and Albert Joseph appeared separately before Magistrates Lovely, Afiq Agoes and Jessica Ombou Kakayun.

Seven of them – Hanaffie, Soo, Alsun, Rujinah, Hapi, Voo and Arde pleaded guilty to having syabu as framed under Section 12 (2) of the Dangerous Drug Act 1952 provides for a fine of up to RM100,000 or up to five years jail or both on conviction.

Hapi and Soo were jailed 24 months and 18 months respectively, Hanaffie and Arde were handed 14 months, Alsun and Rujinah were sentenced to 11 months and 10 months, respectively, while Voo was fined RM2,000 or six months jail.

Jinimal, Nazrul, Samman, Kelson and Albert admitted to taking syabu at separate locations here.

Samman and Kelson were fined RM2,000 and RM1,700 respectively or eight months jail, Jinimal and Nazrul were handed seven months jail while Albert received six months jail.

Taking drugs under Section 15(1) of the of the Dangerous Drug Act provides for a fine of up to RM5,000 or up to two years jail on conviction.
