Kota Kinabalu: Former foreign minister Anifah Aman’s appeal against the election court ruling that his victory in the Kimanis parliamentary seat was null and void will be heard on Dec 2.

James Ligunjang, the secretariat of Anifah’s MySabah group, told FMT the case will likely be heard at the Kota Kinabalu court complex here.

Anifah filed the appeal through his lawyer Ansari Abdullah on Oct 27.

Ansari said his client was forced to appeal the decision as the Election Commission had chosen not to challenge the ruling.

Anifah was cleared of bribery and graft allegations on Aug 16 although the election court declared the poll results in Kimanis null and void as an additional 384 ballot papers had been improperly cast in Kampung Brunei and another 54 at SJK Cheng Meng.

Anifah won the seat by a narrow margin of 156 votes, obtaining a total of 11,942 votes against Warisan’s Karim Bujang who garnered 11,786 votes in the general election last year.

He later left Umno and became an independent.

Karim filed the election petition on June 18 last year, naming Anifah and the Election Commission (EC) as defendants.

The EC initially dismissed the petition but this was overturned by the Federal Court.
