Trespassing: Filipino fishermen given 3 months' jail
KOTA KINABALU: Two Filipino fishermen were penalised by the Magistrate’s Court here Thursday for trespassing an oil platform area to fish last week.

Ahmad Hassan, 30, and Lagi Muhajil, 31, pleaded guilty separately before Magistrates Jessica Ombou Kakayun and Lovely Natasha Charles to committing the offence at the ERB West oil platform area, respectively at 10.15am and at 10.20am on Nov 13.

Ahmad was jailed three months and fined RM500 or one month jail while Lagi was sentenced to three months’ jail.

On Ahmad’s case, the court heard that he was detained by marine police for fishing under the oil platform that had been declared a protected area and place.

Ahmad confessed to fishing in the area even though he knew it was prohibited for fishing activity.

Both Ahmad and Lagi were charged under Section 7 of the Protected Areas and Protected Places Act 1959 which carries a jail term of up to two years or fine of up to RM1,000, or both, on conviction.

Unrepresented, they requested for a lenient sentence.

The court ordered them be referred to the Immigration Department.

Meanwhile, another Filipino was jailed seven months for having stolen jewellery.

Azmal, 20, admitted before Lovely to having two watches, one necklace and two bracelets at 11am on Oct 12 at Kg Lok Urai.

He had committed an offence under Section 411 of the Penal Code which carries a jail term of up to five years or fine, or both, on conviction.

Azmal was also ordered to be referred to the Immigration Department thereafter.
