No bail for 10 prisons personnel charged with inmate murder

KOTA KINABALU: The 10 prison personnel including an officer, charged with murdering an inmate at Kepayan Prison, will have their case mentioned again on Jan 10, next year.
The accused were brought to the Magistrate’s Court Monday for mention of their case.

They were prison inspector Dzulfikri Mohd Safri, 28, and wardens Barry Jipmon, 30, Farizan Mokri, 40, Mohd Saiful Saidin, 34, Amran Yasik, 25, Ab Mutalib @ Talib Abd Rasul, 40, Zerry Maidin, 33, Tomy Momoh, 36, Shahryll Nazry Wan Sofian, 25, and Muhammad Fazi Lakui, 32.
They were jointly accused of murdering one Shainal Mukhtar, 36, in a cell of Gemilang Block, Kota Kinabalu Central Prison, Jalan Kepayan, at 4.30pm, on Oct 4.
Magistrate Lovely Natasha Charles was informed by the prosecution that the chemist’s and post mortem reports were still pending despite a second letter sent to the relevant authority requesting for update of both documents.
Deputy Public Prosecutor (DPP) Khairuddin Mohd Idris said the prosecution would follow up the progress of both reports and applied for another new date for re-mention of the case.

Lead counsel for all 10 accused, PJ Perira, said he has no objection to the application.
He, however, requested for the prosecution to speed up the reports and also the forensic report.

Earlier, Perira informed the court that in representing the 10, he was being assisted by counsel Hairul V. Othman, Dominic Chew and Ariel Dasan.
The personnel were first produced in the Magistrate’s Court on Oct 29 but no plea was recorded from them.
They face the death penalty if convicted under Section 302 of the Penal Code.

The court ordered them to be remanded further pending the mention date as the charge framed against them has no provision for bail.
