Sexually abusing niece: Man to know fate Jan 6

Kota Kinabalu: A 39-year-old man charged with sexually abusing his nine-year-old niece will know his fate on Jan 6 next year.Sessions Court Judge Indra Ayub set the date for the man when his case was brought up for submissions from both parties on Friday.

The man is accused of committing the offence by asking the girl to touch his private part between 7pm and 7.30pm on June 4, 2018 at a house in Ranau.
The offence under Section 14(a) of the Sexual Offences Against Children Act 2017 provides for a jail term of up to 20 years and whipping, upon conviction.
As the man allegedly committed the offence against the girl who is related to him, he faces additional sentence under Section 16 of the same Act which carries a jail term of up to five years and whipping at least two strokes of the cane, upon conviction.
Six prosecution and two defence witnesses were called to testify during the hearing.

Deputy Public Prosecutor (DPP) Adibah Saiful Bahri prosecuted while the man was not represented.
In another court, a 43-year-old man claimed trial to sexually assaulting his six-year-old niece.

The man allegedly committed the offence at 6.40pm on Nov 23 this year at a house in Manggatal.

Pending the date, Sessions Court Judge Azreena Aziz ordered the man remanded further.
