Anifah may sue EC over loss of MP seat

KOTA KINABALU: Former Foreign Minister Datuk Seri Anifah Aman (pic) will file an application seeking a revision of the Federal Court’s decision in upholding the Election Court ruling nullifying his victory in the Kimanis parliamentary seat in the last General Election.

Anifah’s special officer Datuk James Ligunjang in a statement issued Saturday said following the Federal Court’s decision on Dec. 2, Anifah agreed to review two follow-up actions.

One is to file an application for revision to the Federal Court to dismiss the Federal Court’s decision.
The second would be to file a compensation claim against the Election Commission for failure to conduct the Kimanis Parliamentary Election on May 9, 2018 in accordance with election laws and regulations including negligence in defending the allegations in the election petitions.
On Dec 2, the Federal Court in Putrajaya unanimously dismissed Anifah’s appeal to set aside the Election Court ruling and held that the Election Court judge had not erred in the findings of facts.
The Election Court here had, on Aug. 16 this year, declared null and void Anifah’s win in the Kimanis seat in Sabah in the 14th General Election (GE14).
Parti Warisan Sabah candidate Datuk Karim Bujang filed the petition on June 18 last year to challenge the election result.

Anifah, who is a former foreign minister, had won the seat with a 156-vote majority, securing 11,942 votes against Karim’s 11,786 votes.
Another candidate, Jaafar Ismail of Parti Harapan Rakyat Sabah, had obtained 1,300 votes.

Anifah, who won the seat on an Umno ticket, quit the party to become an independent MP.
