Murder of inmate: Wardens’ case deferred to Feb 27

Kota Kinabalu: The Magistrate’s Court on Friday adjourned to Feb 27 the case of 10 prison personnel including an officer charged with murdering an inmate at Kepayan Prison.

Magistrate Lovely Natasha Charles set the date for the 10 accused during mention of their case before her on Friday following an application for a further mention date by the prosecution.

Earlier, Senior Federal Counsel (SFC) Khairul Anuar in updating the court on the case said that as of Friday the prosecution have not receive the chemist’s and post mortem’s reports.

SFC Khairul said that the chemist have not completed their examination and that the post mortem would only take place after the chemist completed their examination.

He further told the court that the investigating officer of the case was informed by the chemist that the report would be completed by the end of February this year.

SFC Khairul applied for a further mention date pending the chemist’s report.

Lead counsel for all 10 accused, counsel PJ Perira said that the defence counsel have no objection to the application for further mention date and requested for parties to expedite the medical’s and chemist’s reports.

The 10 accused were, prison inspector Dzulfikri Mohd Safri, 28, and wardens Barry Jipmon, 30, Farizan Mokri, 40, Mohd Saiful Saidin, 34, Amran Yasik, 25, Ab Mutalib @ Talib Abd Rasul, 40, Zerry Maidin, 33, Tomy Momoh, 36, Shahryll Nazry Wan Sofian, 25, and Muhammad Fazi Lakui, 32.

They were all jointly accused of murdering one Shainal Mukhtar, 36, in a cell of Gemilang Block, at Kota Kinabalu Central Prison, Jalan Kepayan near here at 4.30pm, on Oct 4.

They faced the death penalty if convicted under Section 302 of the Penal Code.

The court ordered them be remanded further pending the mention date as the charge framed against them has no provision for bail.

Together with SFC KHairul was Deputy Public Prosecutor Khairuddin Mohd Idris while with PJ Perira were counsel Hairul V. Othman, Ariel Dasan and Dominic Chew.

Counsel Muhamad Amirul Amin stood in for counsel Azhier Farhan, who was holding a watching brief for the victim’s family member.

In another case, a 28-year-old woman was fined RM2,000 or two months jail for engaging in an illegal online gambling activity.

Radzminah Abd Rahman pleaded guilty to committing the offence at 12.45am on Nov 6 at the Mango Daily Grocery III, Jalan Sireh in Tanjung Aru.

The charge under Section 6(1) of the Common Gaming House Act 1953 provides for a fine of up to RM5,000 or up to six months jail or both on conviction.

Pleading for leniency, Radzminah who was represented by a duty counsel informed the court that she was a single mother of one child and currently works as a waitress.
