Alleged assault: AGC decides not to pursue charges

PETALING JAYA: The Attorney General’s Chambers (AGC) will not pursue any criminal charges in connection with allegations of sexual misconduct against a politician.

Solicitor General Datuk Engku Nor Faizah Engku Atek said police have conducted a thorough investigation on the matter. “Part of the investigation is recording statements of various people to ascertain whether any offence was committed under the Penal Code.

“From the beginning, Attorney General Tan Sri Tommy Thomas recused himself from the case due to his relationship with the politician since the 1990s. Thus, a team of deputy public prosecutors monitored by me was tasked at reviewing the statements and subsequently make a decision on the case,” she said in a statement on Tuesday (Jan 14).

After reviewing all the statements included in the Investigation Paper (IP) submitted by the police, the AGC discovered that there were contradiction of material facts that could not support any prosecution under Section 354 of the Penal Code for assault or use of criminal force to a person with intent to outrage modesty or any other sections under the same code, Engku Nor Faizah said.

It is believed that the Solicitor General is referring to the case involving Muhammed Yusoff Rawther, who accused PKR president Datuk Seri Anwar Ibrahim of sexual assault in a statement recorded in Bukit Aman on Dec 9 and 10 last year.

He filed a statutory declaration in November 2019 and subsequently lodged a police report on Dec 7.

Anwar denied the allegations, saying he was campaigning in the Port Dickson by-election on the day of the alleged sexual assault.

Meanwhile, Anwar says he will not forgive his former research assistant Muhammed Yusoff for making sexual assault allegations against him.

“To ensure justice is upheld, legal action, which was initiated before this, will be continued,” the Port Dickson MP said in a series of tweets.
