RM17K CBT: Ex-MCMC Deputy Director charged

KOTA KINABALU: A former Malaysian Communication and Multimedia Commission (MCMC) Deputy Director of Sabah and Labuan Federal Territory was charged with six counts of misappropriating property which was entrusted to her involving the sum of RM17,930.
The 40-year-old woman pleaded not guilty before Sessions Court Judge Abu Bakar Manat to all charges against her on Wednesday.

On the first to sixth count, the woman is accused of misusing the money which had been paid based on the Memorandum Budget Requisition to facilitate and organise the ‘Program Klik Dengan Bijak’ at six schools namely SMK Sri Nangka Tuaran, SMK St James Tenghilan Tuaran, SMK Perempuan Likas, SMK Datuk Peter Mojuntin Penampang, SM Maktab Sabah and SMK Sanzac.

The offence under Section 403 of the Penal Code provides for a jail term of between six months or five years, and whipping, and liability of a whipping, on conviction.
The mother of three also claimed trial to the six alternative charges of instructing the assistant director of MCMC which under her supervision to use the Memorandum Requisition of expenses incurred for the Memorandum Budget Requisition to facilitate and organise the ‘Program Klik Dengan Bijak’ for the six schools.

The charge stated that the documents of the programme which containing false information with the intention of deceiving the Sabah MCMC Director K Juslly Elis on the supply of snacks beverages, hampers and accessories to the said schools which was not carried out.

The alternative charges fall under Section 18 of the Malaysian Anti-Corruption Commission (MACC) Act 2009 carries for a jail term of up to 20 years, and a fine of not less than five times the amount of the false details, or RM10,000, whichever is higher, on conviction.
The court fixed Feb 28 for case management and offered bail to the woman of RM10,000 with RM6,000 deposited in one local surety.
The woman was also ordered to surrender her passport to the court and to report at MACC department once in two months.
Earlier, Prosecuting Officer Michael Joimin Severinus from MACC proposed bail at RM10,000 in two local sureties with several conditions.
But, counsel Mohammed Fareez Mohammed Salleh who defended the woman asked for a lower bail amount saying that his client had three small children aged five, six and ten year old, to look after.

Fareez said his client had lost her job in October 2017 and she is currently helping her husband’s catering business.
He added that the woman also needed to take care of her father who is suffering from cancer stage five.
