Death for trio on murder, drugs upheld
KOTA KINABALU: Two foreigners and a local man lost their final appeal against their respective conviction and death sentence for murder and drugs trafficking on Tuesday.

Federal Court Justices Chief Justice Tan Sri Tengku Maimun Tuan Mat, Chief Justice of Malaya Tan Sri Azahar Mohamed, Datuk Seri Haji Mohd Zawawi Salleh, Dato’ Abang Iskandar Abang Hashim and Dato’ Zabariah Mohd Yusof dismissed the appeal by Jun Jajah, Baharudin @ Kadir Abu Nawas and Lau Shui Jimg after hearing submissions from their respective counsel and the prosecution as respondent.

The court held that there were no merit in their appeal, affirmed the conviction and sentence imposed on them respectively.

Filipino Jun, 42, was appealing against his conviction and death sentence imposed by the High Court.

He was on Dec 9, 2016 found guilty by the Tawau High Court to murdering his employer one Kong Chau Chin, 78, at 5.10pm on March 1, 2015 at Asia Café Jalan Singgah Mata in Lahad Datu.

The offence under Section 302 of the Penal Code carries the death sentence on conviction.

The Court of Appeal dismissed his appeal on March 5, 2018.

Jun was represented by counsel Sharatha Masyaroh John Ridwan Lincon.

Meanwhile, Baharudin, an Indonesian was on Feb 3, 2017 was sentenced to death by the Tawau High Court after he was found guilty to murdering one Rahmah Ruma, 47, also an Indonesian at 6.30am on Nov 14, 2014 at a workers house at Bukit Piton Forest Reserve in Ulu Segama, Lahad Datu.

His appeal was rejected by the Court of Appeal on March 07, 2018.

Another appellant, Lau was appealing against his conviction and death sentence for trafficking 688.5gm of syabu.

Lau was found guilty by the Tawau High Court Nov 9, 2017 for committing the offence at 2pm on March 27, 2015 at a parking lot of Hotel Silam Dynasty in Lahad Datu.

The offence under Section 39B(1)(a) of the Dangerous Drugs Act carries the death penalty on conviction.

His appeal to the Court of Appeal was dismissed on 24 Sept 2018.

Lau was represented by Counsel Kimberly Ye and Flavian Edward Henry.
