TYT should have acted likewise in  Musa’s case: Rahman

Tuaran: The appointment of Tan Sri Muhyiddin Yassin as 8th Prime Minister by the Agong is a correct decision as it is in accordance with the Constitution, just like Tan Sri Musa Aman was also initially appointed Chief Minister by the Sabah Head of State, according to Umno Supreme Council member Datuk Seri Abdul Rahman Dahlan (pic).

Rahman said an interesting thing from the manner in which the Agong addressed the national political turmoil is how he sought to find a solution that was in accordance with the provisions of the Constitution.

“With the correct decision made by the Agong in accordance with the Constitution, it is hoped that the honourable and learned judges in the Federal Court would revoke the appointment of Shafie as the Sabah Chief Minister,” he said, referring to the appeal that is now before the court.

The High Court and Court of Appeal earlier ruled in favour of current CM Datuk Seri Shafie Apdal.

“Interpretation of the Constitution states that after the King has made the decision to appoint a PM, and subsequently another group feel that they have a majority, then that particular group will be asked to test the support for the newly appointed PM in Parliament. The King cannot be used to change his decision.

“In 2018 during the fight for the Sabah Chief Minister position between Musa and Shafie, the Head of State (TYT) had initially accepted statutory declarations (SDs) from the state assemblymen brought by Musa and subsequently appointed Musa to swear in as the Chief Minister.

“Hence, the TYT cannot appoint Shafie as the Chief Minister even though the latter (Shafie) brought in a new set of SDs,” he said.

If Shafie felt that he had enough support from state assemblymen, Rahman who is also Umno Tuaran Chief, said what would be a wise decision by the TYT at the time would have been to advise Shafie to bring in a no-confidence motion in the Sabah State Assembly.
