Jailed for having stolen DBKK motorcycle
Kota Kinabalu: A 29-year-old mechanic was jailed 13 months for having a stolen motorcycle.

Magistrate Afiq Agoes handed the sentence to Azman Jaafar who pleaded guilty to the charge against him on Tuesday.

He was found having the stolen motorcycle at 6.10pm on March 27 this year at Sulaman Central Manggatal, near here.

The offence, under Section 411 of the Penal Code, carries a jail term of between six months and five years, and liable to a fine, on conviction.

The court ordered Azman to serve the jail sentence from the date of his arrest.

During mitigation, counsel Lawrence Lim from the National Legal Aid Foundation who represented Azman, asked for a light sentence saying that Azman had no fixed income and earned RM80 a day.

Lim informed the court that during his arrest, Azman did not run away. Lim also explained why his client was at the scene – to fix the motorcycle.

However, Prosecuting Officer Inspector Lim Swee Beng urged the court to impose an adequate sentence on Azman.

The court heard that the motorcycle, which belonged to the City Hall (DBKK), was reported missing and believed to be stolen on March 18 this year. A police report was then lodged by City Hall staff pertaining to the matter.

On March 27, the police stopped a motorcycle ridden by a man, later identified as Azman.

Further check on the motorcycle showed it was the same motorcycle which was reported missing.
