MCO: Man jailed,  fined over alcohol
Tuaran: A 22-year-old man who went out to buy alcohol during the Movement Control Order (MCO) was jailed four months and fined RM500 or two weeks’ jail.

Sessions Court Judge Ummu Khaltom Abd Salim, who sat as a Magistrate, handed the sentence to Rapheil Jamrin on Wednesday.

Rapheil pleaded guilty to breaching the MCO at the roadblock along Jalan Gayang here at 11.28pm on March 27.

The charged stated that Rapheil violated the MCO by moving from Kota Kinabalu to Tuaran which is the affected area without intention of doing any of the things provided for under Regulation 3 (1) of the Prevention and Control of Infectious Diseases (Steps in the Infected Areas) 2020.

The offence, under the Regulation 7(1) of the Prevention and Control of Infectious Diseases Act (Steps in the Infected Areas) 2020, provides for a jail of up to six months, or fine of up to RM1,000, or both, on conviction.

During mitigation, Rapheil, who was not represented, asked for only fine to be given to him saying that his parents are not working and that he has a brother who is currently schooling.

However, Deputy Public Prosecutor Rozana Abdul Hadi urged the court to impose a deterrent sentence on the grounds that Rapheil had committed a serious offence. Rozana submitted that the Government had imposed the MCO for 10 days but Rapheil still wanted to go out during the restriction.

She added that the punishment should give a lesson to the public at large as well as to deter others from committing a similar offence.

The court heard that Rapheil had invited his brother from the worker’s quarters at SF Plastic to buy alcohol.

When they arrived at the roadblock, Rapheil’s brother switched off the car lamps and sped towards the roadblock.

The police personnel who were at the area managed to avoid from being hit by the car driven by Rapheil’s brother.

Later, the complainant, who is a police personnel, was then informed that an accident had occurred near the roadblock. Rapheil had suffered injury in the accident while his brother died at the scene.

The traffic investigation had found that Rapheil breached the MCO.
