Boss is fined for violating MCO ruling
TAWAU: A 34-year-old self-employed was fined RM800 or two months’ jail by the Magistrate’s Court here, Thursday, for violating the Movement Control Order (MCO).

Simon Tiong Hang King pleaded guilty before Magistrate’s Dzul Elmy Yunus to committing the offence at KM50 Jalan Semporna-Tawau at about 5.25pm on March 29 while driving a Toyota Hilux from Semporna.

The charge sheet stated that the accused was detained after he was not satisfied with the order given by the enforcement personnel about MCO and dangerously made a U-turn which could have injured the personnel on duty.

The accused was charged under Regulation 3 (1) of the Infectious Disease Prevention and Control Regulations (Langkah-Langkah Di Dalam Kawasan Tempatan Jangkitan) 2020 and punishable under Regulation 7 of the same Regulations.

The regulation provides a fine of not more than RM1,000 or jail term of not more than six months, or both, on conviction.

Prosecuting Officer from IPD Tawau, ASP Dayang Nor Azarinawaty Ag Kachee, appeared for the prosecution while the accused was represented by Jhesseny Kang.

Earlier, Jhesseny applied for a lenient sentence for his client, the owner of a shop in Semporna, who had to go to Tawau to pay his employee’s salary.

He also told the court that it was the accused’s first offence.

However, Dayang Nor Azarinawaty asked the court to impose a heavy penalty as a lesson to the accused and public on MCO compliance.

Meanwhile, Dzul Helmy stressed that even though the employer is allowed to go out for work purpose but they still have to prepare relevant documents.

He also advised the accused to stay calm and obey the order given by authority and not protest.

At the same court, a 19-year-old scrap metal collector was jailed four days after pleading guilty to MCO-related violation last Sunday.

Mohd Ali admitted to committing the offence by moving from Mile 4 Jalan Apas to Mile 3 at about 8.45pm on March 29.

Dzul Elmy then told Mohd that he should comply with the MCO and stay home, and to seek assistance from the village head or the State elected representative to obtain essential items.

“I know there is a need for everyone to earn money during this difficult time. But, you need to know that even if you get to find the scrap metal, no one will buy it during MCO period,” the magistrate said.
