Fined for crashing into roadblock

Kota Kinabalu: A 28-year-old electrician was fined a total of RM2,000 by the Magistrate’s Court Tuesday on two counts of defying the movement control order (MCO) and crashing through a police roadblock.

Elvisius Angati was ordered to pay a fine of RM1,000 or three months jail on each count after he pleaded guilty before Magistrate Lovely Natasha Charles to committing the offences at 9.35pm on April 3 at Jalan Lintas, Kolombong.

On the first count, Elvisius defied the MCO by purposely being in an area declared a Covid-19 contagious area, under the Prevention and Control of Infectious Diseases (Declaration of Infected Local Areas) Order 2020 without police permission.

Elvisius had violated Rule 3(1) of the Prevention and Control of Infectious Diseases (Measures within the Infected Local Areas) Regulations 2020 which is punishable under Rule 11(1) of the same Regulations that carries a fine of up to RM1,000 or a jail term of not more than six months or both, on conviction.

On the second count, Elvisius had purposely drove a vehicle recklessly and crashed through the roadblock at the said place and caused damages to the roadblock tools.

The charge under Section 26 (2) of the Police Act carries a jail term of up to 12 months or fine of up to RM1,000 or both on conviction.

Deputy Public Prosecutor (DPP) Nur Syafiqah Suleiman prosecuting in presenting the facts of the case, said Elvisius, who was on his way home to his elder sister’s house at Bukit Padang, refused to stop at the said roadblock.

Elvisius crashed through the roadblock causing damages to roadblock tools, which caused a loss of RM150, and made a U-turn to Inanam area before disappearing.

He was arrested by police on April 5.

Investigations revealed that Elvisius also had violated the MCO enforced by the government.

Duty counsel Lim Ming Zoong @ Lawrence representing Elvisius, applied for a fine on the grounds that he is currently unemployed due to the MCO and that the reason for him committing the offence was that he had no valid driving licence.

DPP Nur Syafiqah  applied for a deterrent sentence as a lesson to Elvisius and other would-be offenders as Covid-19 was very serious matter.

She added that the case of breaching MCO was on the rise nowadays.

In another case, a 61-year-old fisherman was charged with assaulting a man last month.

Siew Fung Yin pleaded not guilty to committing the crime to one Kong Chee Kong at 12.30p, on March 15 near the Kedai Kopi Ming Fong at Foh Sang, Luyang.

The charge under Section 324 of the Penal Code carries a jail term of up to 10 years or fine or both on conviction.

The court set May 11 for pre-trial case management and released Siew on a bail of RM2,000 in two sureties.

Earlier Inspector Lim Swee Beng prosecuted, proposed bail at RM4,000 but Siew’s counsel Lim requested for a lower bail bond on the grounds that he was the sole breadwinner of his family.
